These Terms & Conditions govern your use of the BoatLocal platform at boatlocal.nl and any bookings made through it. Please read them carefully before using our services. By using BoatLocal, you agree to be bound by these terms.
1. Acceptance of Terms
By accessing or using BoatLocal, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are booking on behalf of a group, you warrant that you have the authority to bind all group members to these terms.
We reserve the right to update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the updated Terms.
2. Our Role as a Marketplace
BoatLocal is a marketplace platform that connects customers with independent boat tour operators in Amsterdam. We facilitate the discovery and booking process but are not the operator of any boat tour.
The contractual relationship for the actual boat tour service is between you and the relevant boat operator. BoatLocal acts as an agent and is not responsible for the service delivered by operators.
3. Booking & Payment
- All bookings are subject to real-time availability via the FareHarbor booking system used by our partner operators.
- Prices displayed are in Euros (€) and include applicable VAT unless otherwise stated.
- Payment is processed securely via Stripe. BoatLocal does not store your payment card details.
- A booking confirmation will be sent to your email address after successful payment. This confirmation constitutes your booking voucher.
- Private boat bookings may require a minimum booking amount. Shared tour bookings are priced per person.
4. Cancellation Policy
Important: Each boat operator has their own cancellation policy. The specific cancellation terms applicable to your booking will be displayed during checkout and included in your confirmation email.
General guidelines:
- Many operators offer free cancellation up to 24–48 hours before the departure time. Check the specific policy on your booking confirmation.
- Cancellations within the operator's cancellation window may result in a partial or full charge.
- No-shows (failure to arrive at the departure point on time) are typically non-refundable.
- To cancel or modify a booking, contact us at hello@boatlocal.nl as early as possible.
5. Operator Responsibilities
Boat operators listed on BoatLocal are responsible for:
- Maintaining valid licences, insurance and safety certificates required by Dutch law
- Operating their vessels safely and in compliance with applicable regulations
- Providing the service as described on their BoatLocal listing
- Managing cancellations and refunds in accordance with their stated policy
6. Liability
To the maximum extent permitted by Dutch law:
- BoatLocal is not liable for any loss, injury, damage, delay or disappointment arising from a boat tour operated by a third-party operator.
- BoatLocal is not responsible for cancellations caused by extreme weather, force majeure or circumstances beyond the operator's control.
- Our total liability to you (where applicable) shall not exceed the amount paid for the specific booking giving rise to the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
7. User Conduct
You agree not to use BoatLocal to:
- Make fraudulent or speculative reservations
- Misrepresent your identity or the size of your group
- Circumvent any technical measures or scrape our content
- Post false or misleading reviews
Violation of these terms may result in cancellation of your booking without refund and prohibition from using the platform.
8. Intellectual Property
All content on BoatLocal — including text, images, logos, design and software — is owned by or licensed to BoatLocal and is protected by Dutch and European intellectual property law. You may not reproduce, distribute or create derivative works from our content without prior written permission.
9. Governing Law
These Terms & Conditions are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of BoatLocal shall be subject to the exclusive jurisdiction of the competent courts in Amsterdam, Netherlands.
As a consumer in the EU, you may also have the right to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
